Please join Victoria Christoff, GW Law’s government procurement fellow and visiting associate professor, as she presents her article "Getting Back on Track: The Need to Clarify 'In Connection With' Under the Tucker Act to Provide a Path Forward for Protests Involving Prototype OT Agreements." The article addresses an unsettled jurisdictional issue concerning the Department of Defense’s popular contracting vehicle, an “other transaction” agreement for a prototype project. The issue is whether the U.S. Court of Federal Claims has jurisdiction over protests of such contracts under the Tucker Act, or whether such protests belong in federal district court. Professor Christoff argues that the answer to this jurisdictional question turns on the application of the statutory phrase “in connection with” under § 1491(b)(1) of the Tucker Act and proposes three different standards for applying this inquiry.
